Legal Duty
Eldercare Specialists, INC is required by law to protect the privacy of your personal health information. The Notice of Patient Information Practices describes how we may use and disclose your protected health information to manage and provide personal care and health care and for other purposes that are required or permitted by law. It also describes your rights to access your protected health information including demographic information, that may identify you and relates to your past, present or future physical or mental health or condition and related health care services.
Use and Disclosures of Health Information
Eldercare Specialists uses your personal health information for treatment, care management services, obtaining payment, obtaining personal care and healthcare services, conducting internal administrative activities and to support operation of Eldercare Specialists.
Eldercare Specialists may use or disclose your personal health information without prior authorization for public health purposes, for auditing purposes, for emergencies, if you are a danger to yourself or others, or if disclosure is mandated by the California Elder/ Dependent Adult Abuse reporting law, federal, state and local laws, a judicial board, administrative proceeding or law enforcement.
In any other situation, Eldercare Specialists’ policy is to obtain your written authorization before disclosing personal health information. If you provide us with a written authorization to release your information for any reason, you may later revoke that authorization to stop future disclosures at any time. Eldercare Specialists may change this policy at any time.
Patient’s Individual Rights
You have the right to review or obtain a copy of your personal health information at any time. You have the right to request that we correct any inaccurate or incomplete information in your records. You also have the right to request a list of instances where we have disclosed your personal health information for reasons other than care management, payment or related administrative purposes.
You may also request in writing that we not use or disclose your personal health information for care management, payment and administrative purposes except when specifically authorized by you by you, when required by law, or in emergency circumstances. Eldercare Specialists will consider these requests on a case-by-case basis, but we are not legally required to accept them.
